ARTICLE 1 — IDENTIFICATION OF THE SERVICE PROVIDER

These General Terms and Conditions of Sale (hereinafter the “Terms”) govern the services offered by:

Hereinafter referred to as “Les Carnets d’Agnès”.

ARTICLE 2 — PURPOSE AND SCOPE

These Terms define the conditions under which Les Carnets d’Agnès offers its clients travel advice and planning services, particularly in Morocco.

They apply to services ordered by private clients and, where applicable, by business clients.

Any order implies that the client has read and accepted these Terms, subject to the applicable mandatory legal provisions.

The applicable Terms are those in force on the date of the order.

ARTICLE 3 — NATURE OF THE SERVICES

Les Carnets d’Agnès works as a travel planner.

As such, the company offers in particular:

  • the design of personalised itineraries;
  • the selection and recommendation of destinations, places and stages;
  • suggestions of accommodation, restaurants, activities and experiences;
  • the provision of useful links to the websites of the providers concerned;
  • the preparation of documents and practical advice intended to make it easier to organise the trip.

The exact content of each service depends on the offer presented to the client at the time of the order.

Les Carnets d’Agnès provides an advice and itinerary design service. Unless expressly stated otherwise in a contractual offer and subject to the applicable regulations, the company does not itself sell the nights of accommodation, transport tickets, meals, excursions or other tourist services recommended.

The client remains free to choose the providers with whom they wish to book, and makes their bookings and payments directly.

Les Carnets d’Agnès does not collect the price of the services booked directly with these providers.

The mere provision of links or recommendations does not, in itself, constitute a booking made by Les Carnets d’Agnès.

ARTICLE 4 — PRE-CONTRACTUAL INFORMATION AND ORDERS

Before placing any order, the client reads the description of the service, its content, its price and any special conditions communicated to them.

The order may be placed by the means offered by Les Carnets d’Agnès: online form, email or any other means expressly accepted by the company.

The order is considered final when:

  • the client has accepted the offer and these Terms;
  • the information needed to carry out the service has been provided;
  • the agreed payment has been made, or the agreed payment terms have been met;
  • Les Carnets d’Agnès has confirmed the order.

A preliminary discussion may be offered in order to understand the client’s expectations, dates, indicative budget and preferences.

Any special request not provided for in the initial offer may be the subject of an additional quote.

ARTICLE 5 — PRICES

The prices of the services are given in euros (€), in Moroccan dirhams (MAD) or in any other currency expressly specified in the commercial offer.

The applicable price is the one communicated to the client before their order is confirmed.

Any applicable taxes are indicated in accordance with the regulations in force.

The prices of the services offered by Les Carnets d’Agnès do not include the client’s travel expenses, in particular:

  • transport and plane tickets;
  • accommodation;
  • meals and drinks;
  • vehicle rentals;
  • fuel, tolls and parking fees;
  • visits, excursions and activities;
  • insurance and personal expenses.

These expenses are paid by the client directly to the providers concerned.

Any significant change to the request after the order has been validated may lead to an additional charge, which will first be presented to the client for acceptance.

ARTICLE 6 — PAYMENT TERMS

The payment terms are specified in the commercial offer or when the order is placed.

Unless otherwise agreed between the parties, payment for the service is due before work on it begins.

The accepted means of payment are those indicated to the client at the time of the order.

A personalised service only begins once the order has been confirmed and the agreed payment terms have been met.

In the case of payment in instalments, the due dates and their amounts are specified in writing before the order.

Any late payment may lead to the consequences provided for by the applicable regulations and, for business clients, by the agreed contractual terms.

ARTICLE 7 — PERFORMANCE AND DELIVERY OF THE SERVICE

After the order has been confirmed, the client sends the information needed to design their itinerary.

Les Carnets d’Agnès performs the service in accordance with the content of the accepted offer.

The deliverable may in particular take the form of a digital document, a personalised travel notebook, a detailed itinerary or a selection of recommendations and links.

The estimated completion time is communicated to the client before the order or in the order confirmation.

Indicative time frame: [TO BE COMPLETED].

This time frame may depend on the complexity of the project, on the client providing the necessary information and on the exchanges essential to preparing the itinerary.

Any foreseeable delay will be reported to the client as far as possible.

The service is considered delivered when the agreed document or content has been sent to the client by the agreed means.

ARTICLE 8 — CHANGES AND ADDITIONAL REQUESTS

The client is invited to check carefully the information they provide before work on their itinerary begins.

The number of changes included in the service is specified in the commercial offer.

Number of changes included: [TO BE COMPLETED].

Any additional request or any significant change to the initial project may be invoiced in addition, after the client has been informed and has agreed.

A change requested by the client cannot be guaranteed if it is made late or if the necessary information is no longer available.

Les Carnets d’Agnès cannot guarantee the availability of the accommodation, activities or other services recommended.

ARTICLE 9 — CLIENT’S OBLIGATIONS

The client undertakes to:

  • provide accurate and complete information about their project;
  • specify their constraints, preferences and particular needs;
  • provide the necessary information within the agreed time frames;
  • check the personal and practical information contained in the documents sent;
  • make the bookings and payments themselves with the providers they choose;
  • check the contractual conditions, availability, schedules and prices of the providers;
  • make sure they have the travel documents, insurance and authorisations needed for their stay.

The client remains responsible for their booking choices and for the practical organisation of their trip.

ARTICLE 10 — BOOKINGS WITH THIRD-PARTY PROVIDERS

The recommendations provided by Les Carnets d’Agnès are intended to help the client prepare their trip.

Contracts relating to accommodation, transport, activities, restaurants and other services are concluded directly between the client and the providers concerned when the client chooses to book with them.

The general terms and conditions, prices, cancellation conditions and obligations specific to each provider apply to the bookings made by the client.

Les Carnets d’Agnès cannot guarantee the services, prices or availability of these independent providers.

In the event of a change, cancellation, delay, unavailability or difficulty concerning a booking made directly by the client, the client must contact the provider concerned, without prejudice to any legal obligations that may be incumbent on Les Carnets d’Agnès.

ARTICLE 11 — LIABILITY

Les Carnets d’Agnès undertakes to perform its services with care and diligence, in accordance with the content of the accepted offer.

The itineraries and recommendations are drawn up on the basis of the information available at the time they are prepared and of the information provided by the client.

It is up to the client to check essential information before and during their trip.

Les Carnets d’Agnès cannot be held responsible for decisions made by the client, for changes beyond its control or for failures of third-party providers, within the limits permitted by law.

No provision of these Terms may exclude or limit any liability where such exclusion or limitation is prohibited by the applicable regulations.

ARTICLE 12 — CANCELLATION AND TERMINATION

Any cancellation request by the client must be sent in writing to the contact email address of Les Carnets d’Agnès.

The financial consequences of a cancellation depend on how far the service has progressed, on the conditions of the accepted offer and on the applicable legal rules.

Any fees charged or sums retained must correspond to the validly agreed contractual conditions and respect the client’s mandatory rights.

Sums corresponding to services not performed are handled in accordance with the applicable legal provisions and the circumstances of the cancellation.

Bookings made directly by the client with third-party providers are subject to those providers’ own cancellation conditions.

Any legal rights of withdrawal that may apply remain reserved.

ARTICLE 13 — CONSUMERS’ RIGHT OF WITHDRAWAL

Where the applicable regulations grant a consumer client a right of withdrawal for an order concluded at a distance, this right is exercised under the conditions and within the time limits laid down by those regulations.

Where French or European consumer law applies, a legal withdrawal period of fourteen days may in particular be provided for certain contracts concluded at a distance, subject to the legal exceptions.

If the client wishes the service to begin before the end of the withdrawal period, an express request may be obtained where required by law.

The consequences of a withdrawal after performance of the service has begun, as well as any exceptions applicable to digital content, will be determined in accordance with the legal provisions applicable to the contract concerned.

Les Carnets d’Agnès provides the client with the information needed to exercise their rights where these apply.

ARTICLE 14 — FORCE MAJEURE

Neither party may be held liable for a failure resulting from an event that meets the legal conditions of force majeure.

The party concerned will inform the other party as soon as possible, insofar as it is able to.

The consequences of the event on the performance of the service will be examined in accordance with the applicable regulations and the circumstances of the contract.

The itineraries, personalised documents, texts, editorial selections and other content produced by Les Carnets d’Agnès are protected by the applicable intellectual property rules, subject to the rights belonging to third parties.

Unless otherwise agreed in writing, the documents sent to the client are intended for their personal use as part of their travel project.
